DOCTORS ACCUSED OF NEGLIGENCE STILL TO BE SERVED

A distraught husband is still to get his day in Court regarding an action he filed against doctors who he says were negligent in the treatment of his wife. According to the action, the doctors “did medically treat or fail to treat Chrystal Ramsoomair in such a negligent manner which caused her death”.

Husband Lorne Ramsooomair brought a civil action last July against doctors Mordira Seeneth, Ashmeed Mohammed and Deepavalli Rambakkack which allege that they are responsible for his wife’s death.  Boodoo-Ramsoomair, 29, died in 2011, following a Caesarean section at San Fernando General Hospital. The South West Regional Health Authority has accepted liability for the death, but has denied the doctors were negligent.

The action was filed by her husband’s attorney saying that the doctors’ actions were contrary to Section 6 of the Offences Against The Person Act CAP 11:08.

On January 24, High Court Judge Frank Seepersad ruled Ramsoomair could take civil action against the doctors. The doctors appealed, but Chief Justice Ivor Archie and Appeal Court judges Maureen Rajnauth-Lee and Nolan Bereaux agreed with Seepersad’s ruling.

According to Attorney Saira Lakhan the doctors were not served and she herself had only heard of the situation in the media. However, reports in a section of the Trinidad press suggest that when the matter was first heard before Magistrate Mark Wellington, the doctors did not appear and new summons were issued with the matter being adjourned.

Whereas Attorney for Mr. Ramsoomair, Allister Khan said that he would do his utmost to have the respondents appear in Court, San Fernando Magistrate Annette McKenzie ordered summonses to be issued forthwith. McKenzie further ordered that the summonses be issued by the Summons Officer.

Ramsoomair is also being represented by attorneys Israel Khan and Ravi Rajcoomar. Lakhan Jagdeo Singh are representing the doctors. She adjourned the case to January 17, 2014.
